Terms of Service.

PicCull is a web application that helps eBay sellers photograph inventory, generate listing copy with AI assistance, look up sold comparable items, and publish listings to eBay. Some features use third-party services (eBay, OpenAI, SoldComps.com, Stripe, Google, Apple) under their own terms — see the Subprocessors page for the full list.

You must be 18 or older to use PicCull. By creating an account you confirm that you are 18+, that the information you provide is accurate, and that you will keep your credentials secure.

You are responsible for everything that happens under your account. If you believe your account has been compromised, change your password and use the “Sign out of all devices” control in Settings, then email security@piccull.com.

You retain ownership of the photos, listing copy, and other content you upload (“Your Content”). You grant PicCull a worldwide, royalty-free, non-exclusive license to host, copy, transmit, process, display, and modify Your Content solely to operate, secure, support, and improve the service for you.

This license does notgrant us rights to use Your Content in marketing materials, for advertising, or to train third-party AI models. We do not provide Your Content to OpenAI, Google, or any other AI vendor for training. Where AI services are used to generate listing text or analyze photos, those inputs are processed under the vendor’s API terms with default no-training settings.

You warrant that you have all necessary rights to upload Your Content, that it does not infringe any third party’s intellectual property or other rights, and that it complies with our Acceptable Use Policy.

PicCull uses AI to suggest titles, descriptions, item specifics, condition notes, prices, and other listing fields based on your photos and inputs. AI output can contain errors, omissions, and factual inaccuracies — including incorrect prices, mistaken identification of items, and fabricated specifications.

You are solely responsible for reviewing every listing before publishing it. PicCull is not liable for listings that contain AI-generated errors, for items mispriced based on AI suggestions, or for eBay account consequences arising from your published content.

This notice satisfies the AI disclosure obligation under California SB-942 (Cal. Bus. & Prof. Code §§22757–22757.4).

PicCull integrates with eBay via the eBay API to publish listings, fetch active comparable items, and pull category taxonomy. You remain solely responsible for your eBay account, its compliance with eBay’s policies, and any consequences (including suspension, fees, restitution, or feedback) that arise from listings you publish — whether or not those listings were AI- assisted.

eBay may change, restrict, or suspend its API at any time. PicCull does not warrant uninterrupted availability of the eBay integration and is not liable for losses resulting from eBay-side outages, policy changes, or rate limits.

Your use of PicCull is governed by our Acceptable Use Policy, which prohibits (among other things) listings for items eBay itself prohibits, items requiring controlled-substance licenses we cannot verify, counterfeit goods, hazardous materials, recalled products, hate-themed merchandise, and content prohibited by OpenAI’s Usage Policies. AUP violations may result in suspension or termination of your account without refund.

Paid plans renew automatically at the interval shown at checkout until you cancel. You can cancel any time from Settings → Billing; cancellation stops the next renewal but does not refund the period in progress unless our Refund Policy says otherwise.

Token balances purchased on pay-as-you-go plans do not expire while your account is in good standing. Tokens are non-transferable and non-refundable except as required by law or under our Refund Policy.

Payments are processed by Stripe, Inc. PicCull does not store or transmit your full payment card data; see our Privacy Policy for details.

You may close your account at any time from Settings → Danger Zone → Delete Account, or by emailing privacy@piccull.com.

We may suspend or terminate your account if you violate these Terms, our AUP, or applicable law; if your use threatens the security or integrity of the service; or if a court or regulator requires it. Where reasonably possible we will notify you first.

PicCull is provided “as is” and “as available.” We disclaim all warranties, express or implied, to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, accuracy of AI output, accuracy of pricing data, availability of third-party integrations, and non-infringement.

To the maximum extent permitted by law, PicCull’s aggregate liability arising out of or related to these Terms or the service will not exceed the greater of (a) the total fees you paid to PicCull in the 12 months before the event giving rise to the claim, or (b) one hundred US dollars (US$100).

PicCull is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost eBay sales, lost listings, eBay account suspensions, lost data, or business interruption.

You agree to indemnify and hold harmless Villemarette Software LLC and its officers from claims arising out of (a) Your Content, (b) your violation of these Terms or our AUP, (c) your infringement of a third party’s rights, or (d) listings you publish via PicCull.

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-laws principles.

We may revise these Terms from time to time. For material changes we will post the updated Terms with a new effective date and ask you to re-accept at next sign-in. Your continued use after the new effective date constitutes acceptance.
